You can argue yourself hoarse over whether the war in Gaza meets the legal definition of genocide. People of good faith do it every day. What you cannot do is look at the last three years and pretend the civilian part is a rumor. Tens of thousands of people who were not Hamas are dead. Many more are maimed. Large parts of Gaza are wreckage. That happened. It’s not up for debate.
Skip the slogan. Look at the street. Gaza’s Health Ministry has reported on the order of 73,000 Palestinians killed and well over 170,000 injured since October 7, 2023. The list does not separate civilians from fighters, which is why the next sentence always turns into a fight. Israel has at times treated that overall magnitude as broadly reliable while disputing the mix. The IDF has said it killed more than 20,000 militants and that the civilian-to-combatant ratio was roughly two or three to one. Other reconstructions, including reporting that used an Israeli list of named dead fighters, imply a much higher civilian share. Fine. Pick a ratio if you need one. You still do not get a world where the civilian dead are a rounding error.
And the place itself is broken. United Nations satellite analysis in 2026 found about 82 percent of structures across the Gaza Strip damaged or destroyed, more than 200,000 affected buildings, including well over 100,000 gone outright. Housing, hospitals, water systems, and schools took the same beating. Debris is measured in the tens of millions of tons. Recovery has been priced in the tens of billions of dollars. Some neighborhoods are not “damaged.” They are gone. A city can still have people living in the wreckage and be, as a functioning city, finished. That is closer to Gaza than a few ruined blocks.
None of that erases how the war started. October 7 still sits at the front of the chain. Hamas and allied fighters murdered about 1,200 people in Israel and took 251 hostages. That is why a war started. It does not make the later civilian dead smaller. Hamas fights from among civilians in houses, hospitals, schools, and tunnels, and that makes the fighting uglier. That still does not turn every person under the roof into a lawful target, and it does not turn a flattened block into a clean shot.
The word genocide keeps showing up because the death is enormous and people want a name that fits the size of it. In the statute that word is narrower than “a lot of civilians died.” It requires intent to wipe out a people as such. That is a claim. Mass death is a fact. They are not the same thing.
South Africa hauled Israel into the World Court over that word. The court issued an emergency order in 2024 and has not finished the case. Some UN shops and NGOs already used the word. Israel says they’re a joke. Follow that fight or walk past the building. Neither move changes how many civilians are dead, and neither one changes who paid for the bombs.
The libertarian view is simpler. The United States paid into this. It is Israel’s main arms supplier and its diplomatic cover. After October 7, more U.S. military aid stacked onto the long-term package already in place, tens of billions once you count the wartime surge, the bombs, and the later sales. Emergency paperwork moved munitions faster than Congress usually allows. Washington vetoed repeated U.N. Security Council resolutions that would have demanded an immediate ceasefire and opened the aid tap on terms Israel rejected. Then it tried to freeze the war: the October 2025 ceasefire, the talks, the committees with hopeful names. That is not standing on the sidewalk. They called it a ceasefire. People in Gaza have still been getting killed, and Israel still holds most of the Strip. Those weapons came out of a country that never took a clean vote to flatten a city. Alliance is not a blank check. That is the libertarian argument. The rest is other people’s press offices.
The Final Say
Governments don’t get a free pass to kill people. And we don’t get to pick our neighbors’ pockets to help them do it. October 7 happened. Tens of thousands of civilians are dead, a lot of them children. The U.S., with your tax dollars, helped pay for the war. End of story.
